Undue Hardship

Undue hardship is the legal limit on an employer’s duty to accommodate a worker. Employers must adjust the job for needs tied to things such as disability, religion, or family status. The duty stops only if the change would create a serious financial or safety problem. Ordinary inconvenience is not enough. In Canada that bar is high. In the United States, disability and religious-accommodation law uses the same name. Most requests should be worked out long before anyone reaches that limit. The employer is expected to try a real accommodation first.
