Reasonable Person

Reasonable Person

A legal concept of what an average person would think or do in a particular situation. The “Reasonable Person” is frequently used in a benchmark to determine of a person was purposefully misled by a contract or other situation. A famous example is that when someone sued the Captain Crunch cereal manufacturer because “Crunch berries” were not real fruit, the courts sided with the manufacturer – a “reasonable person” would not assume crunch berries were a real fruit.
